The Barça asks the no admission of the querella by the case Neymar

The Barça has appeared in front of the Central Court of Instruction number 5 of Madrid to request the no admission of the querella presented by a partner of the club concerning the signing of Neymar. It defends that the facts "are not constitutive of crime"

As it has communicated the club of official form, the FC Barcelona has appeared by means of lawyer and procurator and has presented a writing when considering that the facts related in the querella "are not constitutive of crime". East has been the first movement of the Catalan entity after, the past Friday, the Fiscalía of the National High Court asked to the judge Pablo Ruz that admitted to formality the querella by undue appropriation interposed against the president of the Barcelona, Sandro Rosell, by the signing of Neymar. 

The Catalan club has alleged "the rejection to the true motivation of the complainant", that, according to the Barça "is not another that the instrumentalización of the penal jurisdiction to try desprestigiar to the entity and the figure of the president". Regarding the payment of the 40 million euros to the company N&N (Neymar and Neymar), the Barcelona entity ensures that this quantity is a part of the satisfied price by fichar to the player, included in the 57,1 million euros in that it established the operation. 

The Barça refuses the arguments of the Fiscal Ministry and considers that "it has not existed any simulation neither contractual mutation" between the initial agreements to which arrived with N&N in November of 2011 and those that derived on 3 June 2013 in the final contracting. The controversy, therefore, continues in the air.
