Controversy surrounds LaLiga president, Javier Tebas<\/strong>, once again. After the official filing of a complaint by Miguel Gal\u00e1n<\/strong>, president of the Association for Transparency and Democracy in Sport, accusing him of allegedly leaking confidential economic information related to FC Barcelona<\/a>, the case has taken a new turn.<\/p>

According to the latest update issued by Gal\u00e1n<\/strong> himself, the lawsuit against the head of the employers’ association not only stands but has gained support. According to the complainant, 93 members of the Azulgrana club<\/strong> have already joined the cause, an amount that, in his opinion, is more than enough for the Higher Sports Council (CSD) to raise the petition to the Administrative Court of Sport (TAD).<\/p>

The complaint against Javier Tebas and the role of FC Barcelona members<\/h2>

In a statement sent to the CSD, Gal\u00e1n<\/strong> detailed the legal basis of his accusation. The note focused on the alleged breach of the duty of confidentiality contained in article 5 of the regulations for the preparation of budgets for clubs and SADs of LaLiga<\/strong> and in article 59.1B of the Sports Law (39\/2022)<\/strong>.<\/p>

The first establishes that: “The information, data and documents that the Clubs\/SADs provide to the League in compliance with these Rules will be confidential<\/strong>, without prejudice to the obligations arising from the information requirements of the judicial and administrative bodies”.<\/p>

For its part, article 59.1B asserts that: “The duties of the members of the board of directors<\/strong> and, where appropriate, of the delegated commission of the sports federations or management and direction bodies in the case of professional leagues, are the following:<\/p>

  1. Oppose agreements contrary to the legal system, the statutes or the interest of the entity.<\/li> \t
  2. Keep secret any data or information they know in the performance of their duties, and may not use them for their own benefit or that of a third party.<\/strong><\/li> \t
  3. Refrain from intervening in deliberations and votes on any matter in which they may have a particular interest.<\/li> \t
  4. Not to misuse the assets of the federation or the league or take advantage of their position to obtain financial advantages.<\/li> \t
  5. Not to obtain an advantage with respect to business opportunities that they know in their capacity as members of the board of directors or the delegated commission or equivalent bodies, nor to accept commissions from any member of collegiate bodies of the leagues or federations.”<\/li> <\/ol>

    Possible consequences for Javier Tebas<\/h2>

    If the complaint is confirmed, the case could escalate to the Administrative Court of Sport. In that scenario, if it is determined that Tebas<\/strong> incurred a serious infraction, he would face significant sanctions, including disqualification as president of LaLiga<\/strong>.<\/p>

    It should be remembered that Gal\u00e1n<\/strong> himself claims to have promoted complaints that ended with the disqualification of leaders such as \u00c1ngel Mar\u00eda Villar<\/strong>, Luis Rubiales<\/strong> and Pedro Rocha<\/strong>, which reinforces the seriousness of the current accusation.<\/p>
