The Copa del Rey detonated the controversy by the return of the fans

The Glass of Rey has detonated this week a new bomb, that does not have at all that see with the surprising elimination of the Athletic of Madrid (current leader of LaLiga) in front of the Cornellá of the Second Division B. The entrance of cientos of fans to the stadiums, caused indignation between which wish to witness the meetings of the main domestic championship. For many, results more than contradictory see a Camp Nou or Gave Stefano empty and afterwards a Nou Municipal to pop in the middle of the restrictions by the pandemia of the COVID-19.

The key to understand the controversial situation roots in the Royal decree published in June of 2020, which allowed the return of LaLiga to culminate the past season and contest the current. In said legislation, leaves the ball to the government and to the Ministry of Health. They are these instances those that will have to approve the return of the public, after a previous discussion.

In the article 15, of the quoted decree, puntualiza on the previous appearance: "In the case of the League of Professional Football and the ACB (basketball), the competent administration for the application of the had in the previous section (return of public in the stadiums) will be of the Upper Council of Sports (CSD) previous query to the organiser of the competition, to the Ministry of Health and the Autonomous Communities. The decisions adopted by said organ will attend of way prioritaria to the sanitary circumstances as well as to the need to protect to the sportsmen as to the citizen assistants to the activities and sportive competitions".

What knows , is that the CSD already sustained a meeting with the representatives of The League to allow the entrance of the fanatical to the stadiums. The result of the meeting, was to fix the next 15 January a leaf of route to attain the mentioned purpose, that would help to begin a key stage in the frame of the "new normality" that pretends to establish, at least in the two maximum sportive competitions in Spain.

Now well, it would be worthwhile to explain how it is possible that the meetings of the Glass of Rey can have the presence of fans, a news that gave to know in December Javier Thebes, president of the League of Professional Football, during an interview that offered to 'Jugones' of The Sixth, in which it advanced that the intention is to celebrate officially the return of the fanatical in the final of the Glass of the 2020, which will contest in principle the next 4 April.

Competitions no professional

The paramount reason that allows to the Glass of the King have the fans in the stadiums, is that said competition although they participate clubs of First and Second nor is considered like professional, therefore does not have the supreme obligation to have the guarantee of Health. Like consequence, the Glass and the Supercopa are subject to the protocol of return of the no professional competitions, in which the presence of the fans is supeditada to the decision of the Autonomous Communities.

"CC. AA. They will be able to adopt the necessary measures to guarantee the development of the competitions with eventual presence of public (...) The sportive competitions on the competitions federadas of state field and character no professional root in the Spanish Sportive Federations (FFDDEE), under the tutela of the CSD in attention to the public functions delegates, by what these will be able to adopt the decisions that estimate pertinent on the influx of public in the competition", prays the point eighth of the mentioned protocol.

Besides, it adds that: "The Real Spanish Federation of Football understands that it has to be each club of the official competitions of state field no professional the one who regulate the presence of public in function of the sanitary rule dictated in the territory where situate ".
