The Prosecutor's Office asks to dismiss the accusation of Joan Laporta for the 'Negreira case'

The 'case Negreira' is one of the biggest subjects and complexes in the actuality of the FC Barcelona. Recently, Joaquín Aguirre, the judge to charge of this controversial case, imputed to Joan Laporta, president of the club, accusing it of cohecho. It affirmed that the payments made to the exvicepresidente of the Technical Committee of Referees between 2008 and 2010, during the previous mandate of Laporta, have not prescribed, since they constitute a "crime of cohecho continued".

Nevertheless, it has known recently that the Fiscalía Anticorrupción has requested that it do not impute to the Barcelona president in the 'case Negreira'. They argue that all the crimes that those that the magistrate accuses to the current maximum representative of the institution culé already have prescribed and, therefore, have decided to appeal the decision of the judge.

In what bases the appeal of the Fiscalía?

The Fiscalía sustains that the term of prescription for Joan Laporta would begin when it left the presidency of the Barça in 2010, date in which it produced the last crime. Taking into account this, and considering that the complaint presented in 2023, that is to say, 13 years afterwards and without being directed specifically to the Catalan, these presumptive crimes would be prescribed, independently of the applicable penal type.

The Public Ministry also argues that it does not have felt to pursue to a mandator by the acts committed by his successor, even if it builds the crime continued, as it does it the magistrate. Aunado To this, emphasize that "neither Rosell answers by what did Bartomeu afterwards, neither Laporta by what did these two presidents that him sucedieron in the charge".

Now, once that it has appealed the decision of the judge, only remains to expect the dictamen of the Audience of Barcelona, that will have to pronounce in favour of the magistrate, keeping the imputación to Joan Laporta, or in favour of the position of the Fiscalía. This, fits to stand out, would have to resolve in a term estimated of two to three months.
