UEFA has confirmed that, from now on, it will allow clubs that have the same owner to participate simultaneously in competitions in Europe... Will there be consequences?

It appears a new chapter in the controversies of the UEFA. This Friday, has confirmed that two teams that are of the same owner will be able to coincide in European competitions simultaneamente, in the middle of the dispute that had seeded by different cases, but with special attention to the AC Milan (Champions League) and Toulouse (Conference League). They add to the Aston Villa and Vitória of Guimarãis; Brighton and Saint-Gilloise.

The Organism of Financial Control of Clubs of the UEFA (CFCB) has confirmed that it has allowed this measure by the "significant changes by part of the clubs and his investors related", as it is the reduction of the participation of the investors in one of the two teams (to an independent part) or the restrictions in the possibilities to fund to more than an entity or not having a representative in the managerial board or appoint to the members of the same, as well as the inability to be in the General Assemblies or take important decisions, in general.

To achieve the seen well by part of the UEFA, the clubs that are in this position have agreed that they will not make movements in the market of signings between yes, at least until the month of September of 2024. Of the same way, will not have at all in group: neither commercial agreements, neither observers, databases... By his part, the organism rector of the European football engages to be followed with lupa the situation of all the clubs.

The whole communiqué of the UEFA

"The Camera First of the Committee of Financial Control of Clubs of the UEFA (First Camera of the CFCB) had opened previously procedures against:

- Aston Villa FC (ENG) and Vitória Sport Clube (BY);

- Brighton & Hove Albion FC (ENG) and Royal Union Saint-Gilloise (BEL); and

- AC Milan (ITA) and Toulouse FC (FRA)

Because of a possible conflict with the norm of multipropiedad of clubs foreseen in the Article 5 of the regulation of competitions of clubs of the UEFA.

After the implementation of significant changes by part of the clubs and his investors related, the First Camera of the CFCB accepted the admission of the clubs mentioned for the competitions of clubs of the UEFA for the season 2023/24. The CFCB considered that the significant changes implemented did that the clubs fulfilled with the norm of multipropiedad of clubs, taking into account that to day of today:

Any club, direct or indirectly, possesses or negotiates with values or actions of any another club participant in a competition of clubs of the UEFA; Any club is member of any another club participant in a competition of clubs of the UEFA; Anybody has can any or is involved simultaneously, direct or indirectly, in any capacity in the management, administration and/or sportive performance of more than a club participant in a competition of clubs of the UEFA; and Anybody has control or decisive influence on more than a club in a competition of clubs of the UEFA.

More specifically, the significant changes that applied refer to the structure of property, gobernanza and finance of the clubs affected. These changes restrict substantially the influence and the power of decision of the investors on more than a club, guaranteeing the fulfillment of the norm of multipropiedad of clubs.

Some of the significant measures adopted are significant reduction of the participation of the investors in one of the clubs, or transfer of the effective control and the taking of decisions of one of the clubs to an independent part; significant restrictions in the capacity to provide finance to more than a club; absence of representation in the board of directors and absence of capacity to appoint directly new advisers in the board of directors of more than a club; any capacity to participate in the general assembly or capacity to participate in key decisions like the approval of the budgets of more than a club; and any capacity to exert control on more than a club to level of the board of directors or of his general assemblies by means of rights of veto or contractual agreements celebrated with other shareholders.

Besides, like additional proof of his independence, all the clubs involved accepted the following conditions: The clubs no traspasarán players between yes, already was of permanent form or yielded, direct or indirectly, until September of 2024. The clubs will not subscribe any type of cooperation, neither technical or commercial agreements groups; and the clubs will not use any conjoint database of observers or players.

The First Camera of the CFCB will follow supervising to the clubs mentioned to guarantee that the norm of multipropiedad of clubs follow fulfilling in the future".
