LaLiga Exhorts to endorse to the board of the Barça again, by 124 millions

This Saturday, LaLiga issued a note on the guarantee of the FC Barcelona confirming the before published by The Avant-garde: that the patronal requested to the Upper Council of Sports (CSD) an audit to be able to quantify to the detail the guarantee that have to loan the directors of the Barcelona club, that will have to renew before 29 November.

As it informs the newspaper of the Group Godó, "LaLiga considers that the numbers of the last economic closing of the Barça do not correspond in some games with the reality and therefore it asked to study them with a distinct audit to the made by the group barcelonista".

In so much they do not arrive the conclusions of this audit of the CSD and LaLiga can recalcular with all the elements of trial to his scope the new quantity of the guarantee, the patronal fixed the same quantity of 124.651.950 euros of guarantee to loan by the current board when it have to renew it.

"As a result of the news published by The Avant-garde from LaLiga, wants to matizar: That the application of said audit to the CSD produces like consequence that the guarantee presented the past 7 March 2021 by value of 124.651.950 euros, by the current Together Directive of the FC Barcelona , has to be updated according to the Royal decree 1251/1999.

LaLiga, once analysed the information facilitated by the FC Barcelona and attending to the conclusions of diverse juridical and financial reports, requested to the Upper Council of Sports - with date 6 October- an extraordinary audit that allowed to make a correct quantification of the aval, planned faculty in the Additional Disposal Seventh of the Law of the Sport and that LaLiga has exercised in previous occasions, whenever it has resulted necessary.

This audit already has been made and in sight of his conclusions, LaLiga, has quantified and communicated the amount of the new guarantee to the FC Barcelona, although it considers that it exists the need of an ulterior analysis of a series of adjust that they allow to determine of definite form his impact in the result of the exercise in which the current Managerial Board did charge of the FC Barcelona, thus, LaLiga will request to the CSD the enlargement of said audit, although, so that this can make without damage of the obligations of LaLiga, the FC Barcelona will have to substitute the current guarantee by another, of the same amount of 124.651.950 euros, with a force until 17 January 2022, date in which it concludes the term of three months from the approval by the assembly of the club of the accounts of the enclosed exercise to 30 June 2021.

In case of not to make the extension of the guarantee before 29 November will determine the execution of the current, deposited in LaLiga, to cover the losses of the season 2020/2021 imputable to the current Managerial Board, in whose case, the amount executed will be put to disposal of the club, who will have to use it to cancel the deficit reached in the season 2020/2021.

The Law of the Sport, establishes that the guarantee that have to deposit the managerial boards has to reach the fifteen percent of the budget of the cost of the exercise more the negative economic result in the previous exercise derived of the management of the current managerial Board.

Therefore, once determined the losses of the exercise 2020/2021 imputable to the current Managerial Board, LaLiga will communicate to the club the amount by which has to issue the corresponding definite guarantee to the season 2021/2022.

Double request to the Barça, according to LaLiga

To make this calculation that constitutes a legal mandate, after the presentation of the financial states of the FC Barcelona, LaLiga confirmed the need of a greater detail in the información that allowed him make a correct quantification of said guarantee, requiring to the club to such effect. Said request of information was made until in two occasions and to the have not been attended, LaLiga requested, as we signal, to the CSD, the past 6 October, the realisation of an extraordinary audit, with which do not pretend question the annual accounts approved by the club, but obtain the already required information and necessary that allowed him concretise which losses are atribuibles to the Managerial Boards and make like this a correct imputación of the same for the quantification of the guarantee in fulfillment of the Law of the Sport and according to the criteria fixed in the Sentence of the High court of 12 December 2012.

The Law of the Sport forces to the members of the managerial boards of the clubs that take part in professional competitions to answer of the negative economic results that generate during the period of his management and complete said diet of responsibility establishing the obligation to guarantee this responsibility of his members by means of the provision of a banking guarantee".
