The Barça will not be able to fichar until 2016 by the sanction

The TAS has desestimado this Tuesday the resource presented by the FC Barcelona against the sanction of the FIFA and finally will not be able to fichar to any footballer until January of 2016

The TAS (Court of Arbitration of the Sport) has desestimado the resource of the FC Barcelona against the sanction imposed by the FIFA. The court of sportive arbitration has informed this Tuesday by means of a communiqué published in his official web that the Barcelona club will not be able to fichar until January of 2016. According to the sentence, the Catalan team will not be able to reinforce in the two next openings of the market, the one of this winter and the one of the next summer.

The decision will condition the sportive politics of the club, although taking advantage of a suspension cautelar of the sanction, this summer invested more than the usual in forecast to have to fulfil the punishment partially or in his integrity. The Barcelona club was punished with the impossibility of fichar and with 370.000 euros of fine for having broken the legislation on contracting of lower foreign players of age. Barça and the FIFA agreed to subject to the dictamen of the TAS in the modality abbreviated -the sentence exprés- so that the definite decision took before finishing 2014.

Reprimand after it confirmed that there was infringido the norms of the FIFA regarding the register of the number of lower players of age.

When appealing to the CAS, the FC Barcelona looked for to cancel the decision of the FIFA. The parts agreed a
It carried out the procedure accelerated and an audience in the headquarters of the CAS in 05 December 2014 in which the Signpost CAS to charge of the matter (Prof. Petros Mavroidis, Greece, (President), the Mr. Efraim Barak, Israel, and the Prof. Ulrich Haas, Germany) listened the parts, his representatives and his witnesses.

The Special Group ascertained, in particular, that the FC Barcelona had violated the relative norms to the protection of the minors and of the registration of the minors of age that assist to schools of football (articles 19 and 19bis of the FIFA Regulation on the Statute and the Transfer of Players). In consequence, the decision of the FIFA confirms in plenary and the sanction follows valid.

Prohibition displaced to the next two markets

We remember that the prohibition of fichar referred initially to the markets of summer of 2014 and of current winter, but the FC Barcelona attained the suspension cautelar of the sanction by part of the own FIFA, being able to reinforce in the past market estival. Because of the quoted cautelar, the prohibition displaces to the following two periods of signings, that is to say the current of winter and the one of summer of 2015.
