The salary cut in the FC Barcelona squad seems imminent. Beyond the opinion of the players, the club has autonomy to make this type of decision as established in the Workers' Statute
The financial crisis of the FC Barcelona can force to the directive to take drastic decisions. One of them has to see with making an adjust integral to the wages of the staff without consulting previously with the players. In this sense, the club can go down wages protecting in the established in the article 41 of the Statute of the Workers, which explains that "company will be able to agree substantial modifications of the conditions of work when they exist tested reasons".
For the Barça, the current economic situation is the sufficiently delicate as to take this decision. However, the directive headed by Joan Laporta follows managing alternative financial, between them new agreements of sponsorship and the sale of Barça Studios or 49,9% of Barça Licensing and Merchandising (BLM), with which the club could ingresar more than 600 million euros.
This adds to adjust them in the staff, where foresees the exit of players like Frenkie of Jong to do box and free mass salarial. Nevertheless, if the 'crowbars' of Laporta finish fracasando, the drop of wages will be imminent. The same article 41 of the Statute of the Workers arguye that, between the reasons justified to apply the cuts salariales, "will consider such those that are related with the competitiveness, productivity or technical organisation or of the work in the company".
Besides, the statute determines that this type of adjust are definite and, depending of the number of workers affected the measure, will apply of individual or collective form, with distinct forms to make the modification in each case. In this context, considers of collective character the modification that, in a period of 90 days, affect at least to 10 workers in the companies that occupy less than 100 workers; 10% of the number of workers of the company in those that occupy between 100 and 300 workers or 30 workers, in the companies that occupy more than 300 workers.
The players can go out free if they deny to accept the reduction
The most worrisome for the Barça is that if one or several players deny to accept the conditions salariales imposed by the club can remain free notifying his decision with 15 days of antelación. "In front of this unilateral decision from the company can give three distinct stages for the workers. In this case the players could adopt the following posture:
Accept them; not to accept them and impugn them in front of the Courts of the Social; not to accept them and break the labour relation having right to a compensation of 20 days by year (with a maximum of 9 mensualidades) and right to the unemployment", explains the referred article.
This last case could generate a massive exit of players of the staff culé. The strategy perhaps would succeed with players whose future was uncertain in the club and deny to salir (by fault of proposals or desinterés). Nevertheless, arrive to this stage poses a very complicated stage for the directive. During the pandemia of the Covid-19 there was a lot of controversy to agree a reduction of wages, by which if these cuts produce without previous agreement, the internal crisis would be tremenda. From here the importance to attain success with the 'crowbars' to avoid take this type of decisions.
