The FC Barcelona exposes to be fined, in the worst of the cases, with a maximum of 54,6 million euros by the "case Neymar", after, according to the public prosecutor, the Barcelona club was inculpado by a supposed fraud tributario of 9,1 million euros

Everything roots in the fiscal consideration that the Barça did of the 37,92 millions paid in the operation to the player -10 millions in 2011 and other 27,92 millions in 2013 to ensure his signing- and that, according to Inland revenue, would have to have a fiscal retention. The quoted quantities would have to be considered like a premium of signing -quantities that credit to the footballers that arrive to the clubs without that it was precise a traspaso between clubs- and therefore would have to have his corresponding retention like performances of the work.

Once known the figure, the Barcelona club deposited in Inland revenue 13,5 million euros to "give coverage to the eventual interpretations that can give to all the agreements signed" in the "operation Neymar". In any case, the article 305 of the title XIV of the Penal Code, concerning the crimes against the Public Inland revenue and against the Social Security, establishes that the one who by "action or omission, defraud to the state Public Inland revenue (..) Quantities retained or that had had to retain or income to account (..) It will be punished with the penalty of prison of one to five years and fine of the double to the séxtuplo of the quoted quantity".

The resolution of the case is complex, since for the first time it has produced an imputación of crime to a legal person, in this case a club of football.
