In a writing sent to the judge of Gavà that instructs the case, the public ministry considers that the behaviour of the forward of the FC Barcelona and of the selection of Argentina is not criminal since "it did not take part in the taking of decisions on the management and canalisation of his income, neither knew really the importance, dimension, purpose and effects of the entramado societario" articulated purportedly by his father to avoid the payment of taxes.
