The factor that 'saved' Lewandowski from his sanction

The juridical services of the FC Barcelona have dressed of heroes for, to less than 24 hours for the party against the RCD Espanyol, Robert Lewandowski have been absolved of his sanction by three parties in LaLiga Santander. The '9' Barcelona will be present in the derbi Catalan and is the best possible news for Xavi Hernández.

As it has desvelado in the last hours, the Barça did the request to the Central Court Dispute of Madrid during the midday of the day Thursday and received the answer this Friday, just in time so that Lewandowski added to the list of summoned of the Catalan group against the Espanyol, the Saturday to the 14:00 hours (in Spain).

It has been a decision that has generated a lot of controversy and are many those that have pronounced against (like the Espanyol, with a hard communiqué), but the decision of the court of Madrid is justified in that this treating to avoid a "damage irreparable" because the resolution of the TAD was not firm.

The Court has explained that "it has not resorted here 'the sanction' imposed, since the TAD still has not gone in at the bottom of the subject neither has resolved, therefore, the resource interposed against the resolution of the Committee of Appeal of the Real Spanish Federation of Football. What here has resorted and on what asks a tutela cautelarísima is the denial of the suspension by part of the TAD of said sanction between so much resolves the resource".

Annoyance in the Espanyol

Although it has done upsetting in the reasons by which has awarded the measure cautelar to Lewandowski so that it play with normality, from the RCD Espanyol have exploded because, in his opinion, "do not give the requirements to justify the measure cautelar. Specifically, the appearance of good right is especially little defendible having two sanctions of different type, three administrative resolutions desfavorables and a referee's record with presumption of veracity that endorse the sanction".

They have complained that, although they take in account the damages to the Barça, does not happen the same with the rivals: "Likewise, it speaks of damages irreparables to the FC Barcelona without going in to value the damages irreparables to his rivals and to the competition without giving possibility of resource any" and that "the Club considers that this decision to last hour conditions totally this day, that began yesterday Thursday, and to the preparation of the team of face to this meeting. The RCD Espanyol understands that it supposes an offend and an injustice taking into account the precedents with other clubs".
